Terms and Conditions

These Terms and Conditions (“Terms”) govern your access to and use of the YAAGAM Platform and all services booked or purchased through it. By accessing the Platform, creating an account, clicking acceptance, making a booking or paying for a service, you agree to these Terms, the Privacy Policy and the Refund & Cancellation Policy. Users accessing the Platform outside India are responsible for confirming that their use, payment and any import or delivery of Prasad or physical items is permitted in their jurisdiction.
1. Operator and electronic record
The Platform is operated by YAAGAM DEV- TECH PVT. LTD, with registered office at 10/1744, 1076, 1st FLOOR SOWBHAGYA BUILDING, ATHANI, KAKKANAD, 682030, ERNAKULAM. These Terms form an electronic record under applicable Indian law and do not require a physical signature.
2. Definitions
Booking: a confirmed order for a pooja, homam, Chadhava, astrology consultation/report, Prasad, product or another service listed on the Platform.
Devotee: the person in whose name a ritual or offering is requested, whether the account holder or another person authorised by the account holder.
Service Partner: a temple, trust, priest, purohit, astrologer, courier, payment provider or other independent person/entity involved in fulfilling a Booking.
Service Proof: a video, photograph, receipt, update or other evidence of performance where included in the Booking description and permitted by the temple.
Preparation: procurement of samagri or offerings, priest/temple allocation, Sankalp entry, personalisation, packaging or other work committed specifically for a Booking.
3. Eligibility and account security
- You must be at least 18 years old and legally capable of entering a contract under Indian law. A minor may use the Platform only through a parent or lawful guardian.
- You must provide accurate, current and complete account, contact, Sankalp, billing and delivery information.
- You are responsible for activity under your account and for protecting your phone, OTPs and login credentials. Notify support@yaagam.in immediately of suspected unauthorised use.
- You may not impersonate another person, use another account without permission or submit a third party’s personal data without authority.
- If you accept these Terms for a company, trust, temple, family organisation or other legal person, you confirm that you have authority to bind that person.
- You must take reasonable precautions to secure the device and account used for YAAGAM, must not share OTPs or passwords, and remain responsible for activity authorised through your credentials until you notify YAAGAM of suspected misuse.
4. Services offered
YAAGAM may facilitate one or more of the following, subject to availability and the description displayed at the time of Booking:
- online booking of poojas, homams, dosha-nivarana rituals, deity-specific services, daily or festival poojas and temple offerings;
- Sankalp in the name and gotra of the devotee;
- individual or group rituals;
- live, recorded, photographed or otherwise documented ritual updates where expressly offered and permitted;
- Prasad, pooja kits, yantras, energised or personalised devotional items and other physical products;
- astrology consultations, digital reports, Panchang or related spiritual information; and
- customer support, reminders, receipts and delivery tracking.
The exact inclusions, temple, date, timing, priest, language, Service Proof and delivery estimate shown on the Booking page or confirmation form part of the Booking. General images are illustrative unless stated otherwise.
5. YAAGAM’s role and independent Service Partners
YAAGAM operates a digital platform that coordinates devotional services. Unless YAAGAM expressly states that it performs a service directly, temples, priests, purohits and astrologers are independent Service Partners and are not employees, agents or representatives of YAAGAM. We use reasonable efforts to identify and coordinate suitable partners, communicate Booking details and facilitate resolution of service issues. Temple customs, local rules and the priest’s religious judgment govern the manner and timing of rituals.
6. Booking confirmation and acceptance
- A Booking is accepted only after successful payment and issuance of an order/booking confirmation, unless YAAGAM expressly approves another arrangement in writing.
- An automated payment acknowledgement is not, by itself, confirmation that a particular temple, priest, date or time is available.
- YAAGAM may contact you to verify details, request missing information or offer an alternative temple/date before final confirmation.
- We may refuse or cancel a Booking for unavailability, pricing or listing error, suspected fraud, unlawful purpose, safety concerns, temple restrictions or another legitimate reason. Any amount collected for a Booking we cannot fulfil will be handled under the Refund & Cancellation Policy.
7. Accuracy of Sankalp and Booking information
You must carefully verify the devotee’s name, gotra, nakshatra, rashi, birth details, manokamna, preferred date, contact details and delivery address before payment. Inform us of an error immediately. Corrections requested before Preparation begins will be attempted without charge where reasonably possible. After Preparation or the ritual begins, correction may be impossible and the consequences of information supplied incorrectly by you are governed by the Refund & Cancellation Policy.
8. Scheduling, muhurat and changes
Displayed timings may be indicative and may change according to tithi, muhurat, temple operating hours, festival crowds, local conditions, priest availability or temple instructions. A ritual may be performed within the appropriate religious window rather than at an exact minute unless an exact time is expressly guaranteed. Requests to change a Booking are subject to the Refund & Cancellation Policy and Service Partner availability.
9. Temple rules, photography and Service Proof
- Photos, videos or live access are provided only where expressly included and where the temple permits recording.
- Temple sanctity, security rules, crowd control, network availability or religious restrictions may limit the angle, duration, audio, quality or availability of recording.
- Where recording is prohibited or unexpectedly impossible, YAAGAM may provide an alternative update or proof reasonably available. If promised Service Proof cannot be provided and no acceptable alternative is available, the remedies in the Refund & Cancellation Policy apply.
- Service Proof is licensed for the customer’s private devotional use. Public broadcast, commercial reuse, editing that misrepresents the ritual, or distribution for unlawful or defamatory purposes is prohibited without written permission and any required temple/priest consent.
10. Prasad and physical products
- Prasad and energised/personalised items are sacred, perishable or custom in nature. Appearance, packaging and contents may vary according to temple supply, season and local rules.
- Where a specific item is unavailable, we may substitute a reasonably equivalent temple-blessed item, unless the Booking states that substitution is not allowed.
- Delivery estimates are not guarantees. Courier delays, customs and remote-area restrictions may apply.
- The customer must provide a complete serviceable address and be available for delivery. Re-shipping caused by a wrong address, refusal or repeated failed delivery may require additional charges.
11. Astrology and informational content
Astrology, Panchang, muhurat and devotional content are based on traditional systems, interpretive methods and faith. Different practitioners or regional calendars may produce different interpretations. Such content is informational and spiritual in nature and is not medical, mental-health, legal, financial, investment or other professional advice. Consult a qualified professional for decisions in those areas.
12. No guarantee of spiritual or material outcome
A pooja, homam, offering, mantra, astrology service or Prasad is an act of faith and devotion. YAAGAM and its Service Partners do not promise or guarantee a specific spiritual, health, relationship, fertility, educational, employment, business, financial, legal or material result. Benefits described on the Platform reflect traditional beliefs and may vary from person to person. This clause does not remove any statutory consumer right or remedy for failure to provide the service actually purchased.
13. Prices, taxes and payment
- Prices are displayed in the currency stated at checkout, ordinarily Indian Rupees, and include or exclude taxes as clearly indicated.
- A price may include temple offering charges, samagri, priest dakshina, platform/coordination fees, Service Proof, Prasad packaging/shipping, taxes and payment charges, depending on the Booking description.
- Payments are processed by Razorpay or another authorised provider. Your bank, card issuer or payment network may apply conversion or other fees outside YAAGAM’s control.
- If a price or tax is shown incorrectly, we may cancel and refund the Booking or request your approval to proceed at the correct price before performance.
- Paid service charges are not charitable donations and do not qualify for an income-tax deduction such as Section 80G unless a separate eligible donation receipt is expressly issued by an authorised entity.
14. Communications
You consent to receive essential transactional communications relating to registration, payment, Booking, scheduling, Service Proof, delivery, refund, security and support through the contact details you provide. Promotional communications will be sent only as permitted by law and your choices. You may opt out of promotions, but not essential messages required to complete an active Booking.
15. Mobile application permissions and updates
- If YAAGAM provides a mobile application, it may request device permissions such as notifications, camera, gallery/files, microphone or location only for an identified feature and subject to your device controls.
- YAAGAM will not intentionally access your phone book, SMS content, photographs, files, camera or microphone without the permission presented to you. Refusing an optional permission may limit the related feature but should not affect unrelated services.
- Security, compatibility or legal updates may be released from time to time. You may need to install the current version, and an older version may cease to function after reasonable notice where continued support is impracticable or unsafe.
16. Acceptable use and prohibited conduct
You must use the Platform lawfully and respectfully. You must not:
- submit false, defamatory, abusive, threatening, obscene, discriminatory or unlawful content;
- harass, threaten or disrespect priests, temple staff, astrologers, support staff or other users;
- use the Platform for fraud, money laundering, unauthorised fundraising, illegal offerings or any activity harmful to another person or religion;
- attempt unauthorised access, scrape data, introduce malware, interfere with security, reverse engineer or overload the Platform;
- copy, resell, commercially exploit or misrepresent Platform content, reports, photos or videos without permission;
- make a fraudulent refund, chargeback or non-delivery claim; or
- violate intellectual-property, privacy or other rights of YAAGAM, a Service Partner or a third party.
17. User reviews, submissions and complaint handling
You remain responsible for reviews, feedback, images or other content you submit. You grant YAAGAM a non-exclusive, worldwide, royalty-free licence to host, reproduce and display that content for operating, improving and promoting the Platform, subject to the Privacy Policy and any specific consent needed for identifiable devotional media. We may moderate, restrict or remove content that violates these Terms, another published policy or law. You may report allegedly unlawful, infringing, abusive or misleading content through support@yaagam.in or the available in-Platform support channel. Where appropriate, YAAGAM may seek an explanation, preserve relevant records, provide an appeal route, or share information with competent authorities when required or permitted by applicable law.
18. Intellectual property
The YAAGAM name, logo, Platform design, software, text, graphics, compilations and original content are owned by or licensed to YAAGAM and protected by applicable intellectual-property law. These Terms grant you only a limited, revocable, non-transferable right to use the Platform for personal, lawful purposes. No ownership right is transferred to you.
19. Third-party services and links
Payments, messaging, maps, video hosting, app stores, analytics, couriers and external links may be provided by third parties. Their services are governed by their own terms. A link, listing or integration does not by itself mean that YAAGAM endorses every statement, product or service of that third party. YAAGAM is not responsible for an external site or service outside its reasonable control, but this does not affect YAAGAM’s responsibility for a Booking accepted by YAAGAM.
20. Suspension and termination
You may stop using the Platform or request account deletion at any time. We may restrict, suspend or terminate access where you breach these Terms, misuse refunds or chargebacks, provide materially false information, threaten safety, interfere with Platform security, violate law or where required by an authority. Where reasonably necessary and permitted by law, we may preserve evidence, cooperate with competent authorities or pursue legal remedies. Termination does not cancel accrued payment, refund, privacy or legal obligations. Clauses intended by their nature to survive, including intellectual property, confidentiality, disclaimers, liability, indemnity and dispute provisions, will survive.
21. Force majeure
Neither YAAGAM nor a Service Partner is responsible for delay or failure caused by events beyond reasonable control, including temple closure, priest unavailability, festival overcrowding, government or court orders, curfew, epidemic, natural disaster, fire, flood, war, civil disturbance, strike, transport disruption, courier failure, power/internet outage or payment/messaging platform failure. YAAGAM will use reasonable efforts to notify you and provide the options stated in the Refund & Cancellation Policy.
22. Disclaimer of platform warranties
The Platform is provided on an “as available” basis. We use reasonable care but do not warrant uninterrupted or error-free access, permanent availability of every temple/service, or absolute accuracy of third-party information. Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
23. Limitation of liability
To the maximum extent permitted by law, YAAGAM and its officers, employees and Service Partners will not be liable for indirect, incidental, special, punitive or consequential loss, loss of profit, opportunity, goodwill or data arising from use of the Platform or a Booking. For a claim relating to a paid Booking, YAAGAM’s aggregate liability will not exceed the amount actually paid to YAAGAM for the affected Booking. This limitation does not apply to liability that cannot be limited under applicable law, and it does not reduce the specific refund or rescheduling remedies in the Refund & Cancellation Policy.
24. Indemnity
You agree to compensate and hold YAAGAM and its personnel harmless from reasonable losses, claims and costs arising from your unlawful use of the Platform, material breach of these Terms, infringement of third-party rights, fraudulent conduct, or inaccurate information you knowingly or negligently supplied. This clause will be applied only to the extent permitted by law and proportionate to your responsibility.
25. Governing law and disputes
These Terms are governed by the laws of India. The parties should first attempt good-faith resolution through support@yaagam.in. Subject to mandatory consumer-forum rights and other non-excludable jurisdiction, courts at Ernakulam, Kerala, India will have jurisdiction. Nothing prevents a consumer from approaching a competent consumer commission or statutory authority where the law permits.
26. Changes to Terms and Platform
- We may revise these Terms, Platform content, service descriptions or features by posting an updated version and revising the date. Material changes may also be notified through the Platform or your registered contact details.
- Changes apply to future access and Bookings from their effective date. They will not retrospectively remove accrued rights or materially alter a confirmed Booking unless required by law or accepted by you.
- We may correct technical, typographical, photographic, availability or pricing errors and may add, suspend or discontinue features. If a correction materially affects a confirmed paid Booking, the Refund & Cancellation Policy will apply.
27. Assignment, severability, waiver and survival
- If a provision is invalid or unenforceable, it will be modified to the minimum extent needed to make it lawful where possible, or severed, and the remaining provisions will continue.
- A delay or failure to enforce a right is not a permanent waiver. Any waiver by YAAGAM must be in writing.
- You may not assign or transfer your rights or obligations under these Terms without YAAGAM’s written consent. YAAGAM may assign or transfer them in connection with a merger, restructuring, financing, sale or transfer of the business, subject to applicable law and appropriate notice.
- YAAGAM reserves all rights not expressly granted. Provisions concerning payment, intellectual property, confidentiality, data protection, liability, indemnity, disputes and any other provision intended by its nature to continue will survive termination or expiry.
28. Feedback and unsolicited suggestions
YAAGAM welcomes feedback and suggestions. Unless a separate written confidentiality or compensation agreement applies, you grant YAAGAM permission to evaluate and use voluntarily submitted feedback without restriction or payment, and YAAGAM is not required to treat unsolicited ideas as confidential. This does not transfer ownership of personal data or other content governed by the Privacy Policy.
